Terms for CollectHolo and CollectHolo PRO website subscriptions.
These Terms govern the use of CollectHolo and contracts for CollectHolo PRO concluded directly on the CollectHolo website. The provider is CollectHolo GmbH, Luisantring 1 A, 63477 Maintal, Germany ("CollectHolo", "we" or "us"). Our contact details and company information are available in the Imprint.
They apply to consumers and businesses. A consumer is a natural person acting primarily outside their trade, business or profession. Individual agreements take precedence over these Terms where they expressly state so.
CollectHolo provides digital tools for documenting and managing trading-card and sealed-product collections, including collection, portfolio, wishlist, price-history and related features. The precise scope of a PRO subscription is shown before purchase and in the applicable plan description.
Price estimates, market data, availability information and other analytical outputs are informational only. They are not financial, investment, tax or legal advice, and they are not a guarantee of a sale price, value, liquidity or future performance. Please make your own decisions and verify material information independently.
Some features require an account. You must provide accurate, current information and keep your credentials confidential. You are responsible for activity carried out through your account unless you are not responsible for that activity.
You must not use CollectHolo unlawfully, interfere with its security or operation, attempt unauthorised access, circumvent access restrictions, or upload content that infringes third-party rights. We may take proportionate measures, including restricting access, where this is necessary to protect the service, other users or legal rights.
The display of CollectHolo PRO on the website is not a binding offer. By completing the Stripe checkout, you submit an offer to purchase the selected website subscription. We accept that offer by activating the subscription or by sending the contractual confirmation. The contract language and the checkout interface may be English.
The contractual confirmation and invoice data are sent electronically. Before completing the order, you can review the plan and price shown by Stripe. The contract can be accessed through the subscription-management route where available and through your confirmation records.
For website PRO, the price, currency, taxes and billing interval shown in Stripe before the order apply. Payment processing is provided by Stripe. A subscription renews automatically for the selected billing period unless it is cancelled before the next renewal date. The next renewal date is shown in the subscription-management area and in the Stripe billing information.
We may offer trials or promotions. A trial or promotion does not change the recurring price and interval displayed before checkout unless Stripe expressly shows otherwise. Payment failures, chargebacks or overdue amounts may lead to restriction of paid features where legally permitted.
Consumers have the statutory right of revocation for website PRO contracts. The full notice, model form and an additional electronic declaration function are available on our Revocation page. Statutory rules on the commencement of digital services during the revocation period and any value compensation remain unaffected.
Cancellation ends future recurring billing; it is different from revocation. A website subscription can be cancelled through our contract cancellation page or, where available, through the Stripe billing portal. This does not delete your CollectHolo account. Account deletion is a separate process and does not by itself cancel paid recurring billing.
Purchases made through Apple or another app-store provider are contracts with that provider under its terms. Billing, cancellation, revocation and refunds for those purchases are managed through the applicable store, not through CollectHolo's website Stripe routes. This separation does not limit mandatory rights you may have against the relevant provider.
You retain rights in content you submit. You grant us the non-exclusive, worldwide, royalty-free licence necessary to host, reproduce, process and display that content solely to operate, secure and improve CollectHolo for you. You confirm that you have the rights needed to grant that licence.
CollectHolo's software, design, branding and original content are protected by law and remain ours or our licensors'. Third-party card artwork, names, trademarks and related content remain the property of their respective rights holders. You may use the service only as permitted by these Terms and applicable law.
You will indemnify us from third-party claims, including necessary legal-defence costs, asserted against us because of your culpable unlawful or contractual use of CollectHolo or content you submit. We will notify you of such claims without undue delay and coordinate the defence with you where reasonable.
We make reasonable efforts to keep CollectHolo available and secure, but uninterrupted or error-free availability cannot be guaranteed. Maintenance, security work, external data-source changes and events outside our reasonable control can temporarily affect availability. We will take account of users' legitimate interests when planning material maintenance where reasonably possible.
We provide updates required by law, including security updates. We may change digital service features where there is a valid reason, such as technical development, security, legal requirements, abuse prevention or changes by third-party data providers, and where the change is without additional cost and does not impair access to or use of the service beyond what is legally permitted. Where legally required, we will inform you clearly and on a durable medium before a material adverse change and explain your statutory rights.
Our liability for damages and reimbursement of expenses, whether arising from contract, quasi-contract, statute or tort, is governed by the following provisions.
We are liable without limitation for intent and gross negligence, for injury to life, body or health caused intentionally or negligently, under a guarantee assumed by us and under mandatory statutory liability, including product-liability law.
If we negligently breach a material contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract, unless we are liable without limitation under the preceding paragraph. Material contractual obligations are obligations whose fulfilment is essential to performing the contract properly and on whose observance you may normally rely.
In all other cases, our liability for ordinary negligence is excluded. Mandatory consumer rights and statutory rights in the event of defects in digital products remain unaffected.
These limitations of liability also apply to our legal representatives and vicarious agents.
This section concerns changes to the wording of these Terms. It does not allow us to change agreed prices or the agreed scope of service at will; separate legal requirements apply to changes to digital services.
For ongoing contracts, we may change these Terms only where there is a valid reason, the change is reasonable for you, and mandatory law permits it. Valid reasons include changes in law, a final court decision, security requirements, technical changes or a material change to the service. We will notify you of a proposed material change in the form and within the period required by law. Your statutory termination rights remain unaffected.
Our processing of personal data is described in our Privacy Policy. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident outside Germany, mandatory consumer-protection provisions of your country of residence remain applicable. If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is our registered office.
